Hi, we are in trouble of renewing the lease and have no idea how to resolve this!!

PLEASE HELP..

I live in 2 bedroom Apt with my 2 other roommates. We live in this apartment from last October and now is the time to renew the lease.

Renewing date of the lease was supposed to be by August 1st but we asked them to extend the date to decide the renewal for 2 weeks from that VERBALLY.

Today is exact 2 weeks from that and we decided to renew the lease yesterday morning and already let them know that we will renew the lease for 1 more year.

Although, there were 2 couples came by and saw the apartment during last 2 weeks, but let them know we will renew the apartment yesterday but he forced to us to show our apartment to new client yesterday.

HOWEVER, landlord emailed us that we cannot renew the lease and we need to let them know move out date WITHOUT saying any reason. All they told us is that they have another client who will take this apartment so not allowed us to renew.

We have on time payment from the beginning, and have just ONE late payment for August (one of my roommates had sent via bank(on July 18) and it came back(on July 31)), but still it is not illegal, we checked the lease form and it said we can pay before 15 days which is today.

Yes, we are late but still within 15 days and all we need to do is pay the rest of rent(only hers) now.
Also, this cannot be the reason why we need to move out, can it be??


In this case, are we supposed to decide move out, legally?

We really want to renew this apartment and all of sudden, they asked us to move out.

2 weeks extension from renewal date done by VERBALLY, this cannot be active?

We manage our apartment really nicely, payment, no complain, no late fee ever.

I don't know what should I do..

As far as I know, you are only guaranteed a lease renewal if you live in a rent stabilized apartment.

Well, the landlord was playing game on you. You shouldn't have allowed the landlord to enter your apartment for the future tenant in the first case if you want to renew the apartment. The landlord has no right of entering your apartment unless it is for emergency repair.

As the other poster said, if your apartment is not rent stabilized, the lease renewal is up to the landlord.

You should check with your rent history and to check if it is rent stabilized) by calling the Rent Infoline at 718-739-6400. The rent history will be printed and mailed directly to the apartment/building address

If your apartment is rent stabilized, you can stay in your apartment even without the renewal lease. One bonus point for you with no renewed lease is that the landlord can not increase the rent unless the landlord offer the lease renewal.

In case your apartment is not rent stabilized, if you can not find your next apartment before the renewal date, you can still stay in your apartment, though the landloard may start court evicting process. However, it is going to take several months to half a year for the landlord to get the court to start the eviction. I think long before that time, you should have already found your next place, so the eviction will be no issue.

Regardless of whether your apartment is rent stabilized, it is illegal for the landlord to change the lock of your apartment or throw your stuffs away. If the landlord does that, call the police immediately by 911, please be sure to bring your ID and other important documents with you to show the police that you are currently living at the apartment. The same way you are free to move when the lease is up ,unless the apartment is stabilized the same applys to the landlord and renewing your lease.

Unless your apartment is rent stabilized, the landlord has no obligation to renew your lease .
