I am currently subletting an apartment I am under lease for until early next year and, of course, have run into problems collecting rent. The subtenants have paid the first few months but now seem to have run out of money and are telling me they can't pay. I have a security deposit and last months rent from them but I am not about to let that cover this month and just hold my breath hoping things turn around next month. Honestly I am not confident they will be able to pay next month even though they claim to be getting things together financially. Management is aware of the sublease agreement and I have email correspondence with the subtenants agreeing to the rental terms (which don't mention late fees just the monthly fee) but there may be some issues with a valid signature on the agreement. Yeah... The sublease agreement states I can terminate the sublease with 30 days notice but I don't know what kind of legal process I would have to go through after that. Ideally I would tell them find a new place and move out by the end of the month and we'll be square but I want to know if I have any legal recourse here if they don't agree to leave.
