I own a multi-family house in Brooklyn, NYC and I have a basement that I would like to use as an office, my bike trainer and for guests to sleep when they stay.... it is basically a studio apartment but no kitchen and a small bathroom with a toilet and sink. The basement has its own entrance and there are windows at each end of the studio (one to back-yard and one to the front).
Can I use as an office, gym and guest room or does NYC deem this to be illegal? If illegal what penalties could the city issue to me?
Note, I am looking to get a nice comfy sleeper sofa not an actual bed and the studio will have cable / wifi etc.
I was originally looking to rent but legally seemed this is not allowed so I have now opted to use for personal use only... albeit by NYC standards this apartment would be amazing for a single person who doesn't need to cook!
@ SeventhFloor - CofO says it's a 3 family dwelling and doesn't mention the basement. I thought not having a shower / kitchen is a good thing thus not to indicate it being used for 'living'. I assume on that basis I should be able to use without to many issues if an inspector came round?
