I once read a posting online regarding a young man with the same problem in NYC. There is a maximim noice decibel that is allowed to be transmitted between apartments (though I don't know what the exact number is). He purchased the best noise decibel reader he could find (125$ or so) and used it a court evidence that the noise level in his apt exceeded the maximum allowed limit. The landlord had no choice except to let him out of the lease, refund his deposit and even pay him additional money for his stress. It what I would do for sure in this situation.
