So my landlord has her daughter living in basement the bedroom is next to the boiler room. They have a gas stove, I think using my gas line and I know is using my electricity. there is also 1 small window and one entrance. My question is, is this legal?
Unfortunately, basement rentals are always illegal. Of course, if no one knows and you don't have nosey neighbors who can see it and report it than you'll be fine.
Tons of places in NYC rent out their basement as long as no one sees it.

Why not divide your next electrical bill in half and deduct this amount from your rent. He'll never move against you legally because that would expose his illegal apartment and cost him $$$ plenty$$$. Tell him you'll pay full rent when he runs separate wiring to his daughters illegal apartment.
