I didn't see any machines outside to use. Do I have a case?

But more importantly, will this go on my permanent record?

This happened to a friend of mine. Despite having an unlimited Metrocard, she had to pay the fine. I don't think it goes on your record.

So if I pay it wont go on my record? I called the number on the summons and she said I had a 50/50 chance of winning my case. Whatever that means. I'm wondering if I should show up to the hearing with the judge.

yeah, they can't verify if you PAID because you didn't have a TICKET proving otherwise. so in their eyes, you STOLE a ride. when you go to court, plead guilty, tell the court appointed atty (if they give u one) that u wanna pay the money. just pay them the money, and be sure to never get on a SBS without a ticket again

We get threads like this all the time. Id you ride on a select bus you need the paper slip. Saying you had unlimited card doesn't mean anything cause you could've just used that card for someone else. Or maybe you didn't actually have it on you at the time and you just showed the guy who ticketed you a empty metro card.
Think of it this way. It like walking into a movie theater and not paying and then saying well I have money for the movie, I just didn't give it to you and went directly into the movie theater.

I don't know why everyone is telling you to just pay a fine ... I'm not made of money. Same thing happened to be in the SBS BX22. Tried to say I didn't pay when the machines were out of order.

I got on at the Pelham/Whiteplains Rd Stop and the gestapo all boarded the bus on the far end of Fordham/University; Asking for everyone tickets, Anyone that didn't got pulled off and issued a ticket.

I obliged as I didnt have time to argue, I was already late for work. I simply when to the machine after work and snapped photos and them powerless. Showed it to the clerk when I was supposed to appeal, It got tossed.

Take pictures of the machine, weather they be obscured or not and show it, Let the clerks / judges decide.

Goodluck!

If you didn't see any machines on the sidewalk to pay with, then I assume you boarded the bus the usual way and tried to dip your card in the fare box. If so, what did the driver tell you to do?

Claiming the machines are out of order is different from claiming that you didn't see any machines. If the machines are not near the front of the bus when you board, they are usually located at the mid point of the bus stop. The driver should have said something when you tried to dip your metrocard on the bus. The police can't tell if you used your unlimited metrocard or even if the card has money on it. If you are going to use a SBS, make sure you use the machine and get a receipt.

everything is electronic. he can't lie in court and state that the SBS ticket machine was out of order. judge will automatically call bullsh**. the driver doesn't monitor every person who comes on the bus, because one can enter from any door you choose. i emphasize: pay the fine.
