As I said the rules that come with the program are the same rules you go by if you rent to a 9-5 person. If something is not working in the apartment the landlord is responsible to get it fixed.
Same with section 8, you have annual inspections of the apartment where they come in and make sure that the basics standards of living are met. If something is broken that is not deemed the tenants responsibility then landlord is given a good amount of time to resolve the issue. If it is not resolved in a timely manner yes rent will be withheld until it is completed.
However just like a regular tenant who has the right to withhold rent if repairs are needed in their unit.
However as I stated, Section 8 portion of the rent is guaranteed every single month.
The tenants portion if they have a portion is on the tenant to pay and as poster stated that is where most the issues arise.
As I stated not all are bad families or individuals, there are some who really do appreciate their apartments and try to be model tenants. However you don't hear about them just the bad ones.

if you already have a guy who applied and you didn't state your criteria properly, you need to be careful and should probably take the apartment off the market for several weeks and then relist it properly with strict requirments

Why do you need to explain yourself to anyone? Just deny them the apartment. Make a stand and just say that you are not interested to rent to anyone with Section 8. Let them find a place somewhere else.

I don't know if you're aware, but it is now illegal to turn away section 8 tenants in NY. I need a way around that.

In that case I would suggest that you take BlakeJones advice and remove it, then relist it a few weeks later with specific guidelines such as NO SECTION 8. Even if you lose a months rent its not worth the headache.
