you have to ask for that paint job . in no stabilized building i know is it automatically done .

i agree , they likely did not ask and that is why . we don't paint our apartment every 3 years , we may do it once every 6-9 years . we just don't need it nor the work emptying rooms .

Landlord is possibly willing to discuss buyout but I have not responded to their correspondence regarding that matter. Correspondence is one year stale and no follow up.

Lawyer willing to talk for 15% cut (standard I hear) but because of decent but not stellar location won't command UES numbers or even Williamsburg numbers. Let's think upper Flatbush numbers... Then taxes etc... This is Brooklyn BTW.

Rent is slightly below market.

Was thinking of going to them with flat out cash number take it or leave it but not sure what amount I should go to them with.

$15k seems close to a figure I could live with but lawyer would say that's insane. He doesn't have to live here though.

I am a single male no attachments to anything.

I can only see myself remaining sane until June.

I had to change some details slightly just in case someone is watching whom is close to this.


What's my play here?
While you're renovating you should put heavy insulation in the ceiling, noise problem solved

what a waste of your $5000. why bother if the rent is almost at market rate? now i get if rent is like $500 or something you fighting to keep the apartment. and now you want a payout? for what. your landlord has to spend a lot of $ to fix it in order to get a new tenant.

Walls and floors are thin, surprised they haven't broken through.
It's not addressable, it's one of "those" situations. They couldn't change if they wanted to... It's how they "are".
The apartment is live-able just not pretty if you were alluding to condition.
I take responsibility for a poor decision in this entire matter but here I am.

That has little to do with my reply. Of course it's "addressable." The LL could check to see if it's properly carpeted, for starters.

And anyone can change if there's a threat of prosecution or eviction.

Agreed. It's really disgusting. OP never even lived there and now he wants his hand out? For what?

It's horrible that landlords can purchase rent stabilized/controlled buildings and try to flip apartments for profit and it's horrible that tenants can have their hands out for a windfall. Homes should not be a commodity with which to speculate and make fortunes, but maybe that's just the socialist in me speaking. It's gross.

horrible that landlords can sell the apartments at a profit if they are stabilized ? you got to be kidding . that is how investing in real estate works .

no tenant has to move or accept a lease buyout offer . then the apartments can only be sold for a fraction of the value . we have 2 apartments for sale right now with stabilized tenants for .50 cents on the dollar . investor groups want to low ball and offer .35 cents on the dollar so we are not accepting but at .50 cents , done deal.
that is how it works . landlords do not pay full market for apartments with stabilized tenants nor can they sell them for market with these tenants .

the day you can't buy and sell real estate in nyc because the apartments are stabilized is the day you can say good by to housing as you know it here .

buildings and apartments change hands daily .

as far as paying the tenant ? that is nothing new . if the tenant wants to break a lease which is a contract i can hold them to the lease and make them pay .

if i want a tenant to break their contract they have with me i have to pay them . paying to break contracts is standard business and it to is done in all walks of business .

there is nothing out of the ordinary that is involved here

Yeah, the landlord has to spend money to fix his own property that he failed to maintain, that he makes money on. Yah, the tenant should fix the landlord's property at his own expense so the landlord can benefit from someone else's largesse..... LOL.
