§27–2008 Owner's right of access. No tenant shall refuse to permit the owner, or his or her
agent or employee, to enter such tenant's dwelling unit or other space under his or her control to
make repairs or improvements required by this code or other law or to inspect such apartment or
other space to determine compliance with this code
or any other provision of law, if the right of
entry is exercised at a reasonable time and in a reasonable manner. The department may by
regulation restrict the time and manner of such inspections.


§27–2009 Tenant violations as grounds for eviction. Any conviction of a tenant for violation

of this code which:
(1) Results from wilful or grossly negligent conduct and causes substantial damage to the
dwelling units; or
(2) Results from repeated or continued conduct which causes damage to the dwelling unit or
substantially interferes with the comfort or safety of another person; or
(3) Consists of an unreasonable refusal to afford access to the dwelling unit to the owner or his
or her agent or employee for the purpose of making repairs or improvements required by this
code, shall constitute grounds for summary proceedings by the owner to recover possession
of such dwelling unit from the tenant.

§27–2009.1 Rights and responsibilities of owners and tenants in relation to pets



I hope that the landlord counter sues you and puts a lien on your bank account and wages when she wins. You sound annoying.

Basically if you are living in an illegal apartment with a problem landlord, you are essentially screwed. You are hard to evict but ultimately will be evicted. When I moved to S.I. 30 years ago many owners of 1-family homes illegally rented their basements. Over the years that practice has died out as homeowners learned that their basement tenant was very difficult to evict, even for non payment of rent.

Not just in Staten Island. There are just not enough housing for the number of people living here. Many who would otherwise risk renting their basement have decided against it. This inturn exacerbate the housing shortage. I was happy to have found an affordable apartment in a basement. We used our time wisely there and saved our money to buy our first house.

My ex landlord stopped renting after I moved out. It had been empty for years prior to me. She made an exception because I came recommended by a close family member.

The OP needs a lawyer. I think one letter from a lawyer to the landlady would have a significant effect. It would show that the OP means business, and is working with someone who knows the laws well and can use them both to the OPs benefit and the LLs detriment. The LL in this case sounds nasty, but not too sophisticated. Spelling out the impact of the air strike the lawyer could call in on her, both in court and with the agencies might intimidate her into backing off.

Then again, I'm not clear on what the OP wants to achieve, and if it's achievable.

We want to make her pay for our emotional distress and withholding/trashing our mail. She is a very bad person. I'm not even joking. I'm going to make her loose more than money but her dignity. She is a trouble maker. Sad to see landlords in these forums shilling bad info away.

To all of you lanlords, if you have an illegal apartment YOU CANNOT COLLECT RENT. If you are trashing mail THATS A FEDERAL CRIME.

She is going to court for: Illegal Eviction, Illegal apartment, Mail theft, Harrasment. Look out shill, this human might take you to court for your illegal activities.

Anyone that reads this, don't ever EVER take advice from the internet or forums. You don't go to the internet to get a home designed. You go to an architect. You don't go to a forum for answer for your landlords illegal activities. You go to a lawyer and get her/he sued.

This is one down. Many MANY more to go. Staten Island has an infestation of these Slumlords. Funny enough, I know everything about her. Absolutely everything. Mortgages. Deeds. The banks. The insurance. The boilers.Everything. I just need to call every one of those up and this human will get his right to say when this **** needs to stop. This is one of the reasons why rent will continue to go up. Who in their right mind that actually cares about their asset (house) would want to take a risk and end up renting to a tenant like that.

The good landlords are pretty much out the game right now. Cheap housing will continue to shrink because it just isnt worth it
