Google "Is giving a swipe illegal" and you will get multiple articles saying that it is NOT illegal.

You can't sell a swipe -- if you swipe someone in for a dollar, that's illegal.

If you swipe someone in as a courtesy, that's legal.

But, if the person requesting a swipe is caught asking, they could be stopped by the police and possibly hit with a $25 to $50 fine, or a summons to appear in court.

The way people rush others for a swipe is what should be punishable if anything was to be done at all. They rush people and know how to take advantage of the fast moving environment at the turnstile. The people who give free swipes are the ones being manipulated more. The people standing there begging for a free swipe are rushing other passengers in a fast paced environment.

There are many more innocent people being asked than there are people standing there begging and pressuring people into free swipes. I have never given a free swipe but I'd be upset if a police tried ticketing me for the generosity act because they hustle people and know how to work that fast environment.

Default I hate the mindset of it doesn't cost you anything to swipe someone in for free, you're stealing money from the MTA

a train ride without a panhandler is the absolute best, and today I had a sob story free ride riding the downtown C to Trader Joe’s

Opinion: Agreed.....
It is not a fine as long as you are exiting.
It is also not a fine if you swiped but need to use the gate as well.
Example: Mother with stroller at unmanned station.
