Hi. So a bit of background. I live in a co op board out here in queens. Its one of those pre war buildings. Theres no sound proof in any of the walls and floors make a lot of noise
Ive been here for about 8 years. Last year , my downstairs neighbor sent a complaint to management and was told to put in 80% of carpeting in the apt. I complied with whatever they asked me to do. She still kept complaining that I was making noises . The property manager came out here and inspected the apt. He said "its not your fault, you just have squeaky floors". She still kept complaining and had a meeting with the board back in Jan and explained my version which was that theres no kids in the house, we dont run around and take our shoes off in the apt. Unfortunately, she still didnt stop complaining. Today i received another email from the board that i broken the house rules and im making too much noise. They say if it continues, that they're gonna charge me $500 for every incident. At this point im being harrassed. Whether i have carpet not, she keeps complaining.

Also, forgot to mention this lady is on the board. I feel even if i pay the 500, shes still gonna keep complaining. Can the board evict a shareholder?

The following is only my opinion:
I do not think a board member will go out of their way to
chop any person down. Too much at risk.
But let's assume it is truly harassment.
You have to show 100% proof that you are not at fault.
Record your noise levels throughout daily activities and
present that recording as proof and response to the accusation.
60 db is normal conversation 90 db is the sound of a lawn mower
and very loud music is 120 db.
Let the board then decide.
Very suspicious this complaint only began one year ago. Hire an attorney.

Even let's say informal complaints began 4 years ago. You wait 4 years to take action on paper? It's got to be prompted by something or someone. She retired recently and is at home more often prior to this lockdown? She has a sudden health issue? Her daughter brought her new granddaughter who is a light sleeper?
Think long and hard about if you are aware if something in her life has changed in the past year to cause her to escalate the situation.
Hire a lawyer and have him write the board a letter. It won't make you their favorite person, but it will make the more careful in dealing with you.
On the flip side, if you own the apartment, you own the floor. You need to get the floor fixed.
When i talked to a lawyer months ago, he said that anything below the hardwood floors, management is responsible on fixing it. The reason why it squeaks is because over time the nails loosen from the joist to the subfloor, and not to mention is an old building and theres absolutely no insulation at all.
In her list of complaints she listed the noise she heard yesterday. i was cleaning the spare bedroom yesterday from 12-3pm. Then around
230 when i was cleaning the windows, i saw her staring at us from the lobby window . As soon as she saw us, she left.
Its like what i cant move furniture around and clean my apartment during normal hours?
How long has this lady been living in her apt? Has she complained about the previous tenant? Why did the previous tenant sell?
Why don't you have all board members inspect both apts?
