The Police Department agreed to change its policy and allow religious people to be photographed in head coverings so long as their faces were left unobstructed.

An exception would be made during searches for weapons or contraband, or when the officer believes that “the head covering presents a risk to the safety of the prisoner or others,” the settlement said.

Patricia Miller, chief of the Special Federal Litigation Division of the city Law Department, said in a statement issued Monday evening that the settlement agreement was “a good reform for the N.Y.P.D.”

“It carefully balances the department’s respect for firmly held religious beliefs with the legitimate law enforcement need to take arrest photos, and should set an example for other police departments in the country,” she said.

You wouldn't recognize them without the Hijab or vice versa. So you'd need to do both.

That being said how many Muslim Women are out here robbing liquor stores and packing glocks

I'm personally against all outward displays of religious devotion (and actually against anything religious at all), however, I don't really find this to be a big deal. The hijab basically just covers the hair. If they're not going to ask black women to take out their hair extensions for photos, or any similar hair thing -- like orthodox Jewish women's wigs, then I don't think they should ask the Muslims to remove their headscarf.
