I've been doing some research on a couple of properties that I am interested in purchasing as a rental property.
One of the houses is a single family that has been converted (without a permit) to a multi-family. The real estate agent claims it can be legally converted but I know from reading this forum that to legalize an illegal conversion will be a pain in the ass. From the DOB database, I see 3 complaints filed against the address back in 2006/2007 claiming illegal conversion. The inspector never got access to the house and all cases were closed.
What exactly happens when the inspector can't gain access? Is there a fine or a court summons? All it says in the database is "LS4 Posted"
"LS-4 posted" means: DOB couldn't get access, so mailed the owner a letter asking him/her to schedule an inspection.
To find out what hapened, I'd check every conceivable category in DOB's online listing for that property ... not just complaints/violations, but C of O, Actions (which often are _not_ in chronological order!), Permits, Plumbing, Electrical, et al. Relevant info often is tucked away there -- i.e., whether they were fined, filed a permit, corrected the problem, or if DOB decided the complaint was unfounded, so dismissed it.
If there's nothing at all but an LS-4, there's a chance that there was no followup, the complaint just fell into some black hole (or was "adminstratively" closed, which is pretty much the same thing), and it's still in violation.
For more detailed info ... the DOB site is searchable, and has tons of info re: inspection procedures, or you could check with DOB directly.
nothing happens. if the inspector cant gain access, then he/she can't issue a violation, because nothing was inspected. the inspector needs to have access to determine if anything is wrong.
