New York detectives asked the Clackamas County Sheriff's Office to locate Fossen. They did and sent Fossen's driver's license photo to New York. "The picture looks like the same girl I am searching for," a detective responded.
You can see the photos at the link - the women look nothing alike. No offense, but what kind of ramshackle operation are your police officers running over there?
Cops lie all the time. The courts refuse to call them on it, so there's no reason not to. When the cops said: "The picture looks like the same girl I am searching for", they had no idea; they probably hadn't even seen a picture of Nguyen. They just said whatever it took to get what they wanted.
The mantra of criminals & defense attorneys. Its corollary is that "all victims or witnesses are lying or can't identify anyone."
The criminal justice system is just that, a system, but if it were up to defendants & their lawyers, no one would ever be found guilty.

There may not have been a photo of the actual suspect. If a name search produced a photo, it would normally be shown to the victim as part of an array. If he makes a mistaken ID, that's the source of the problem. Even in a legitimate photo line-up, there's a 1 in 6 chance of a false positive. That's why an ID should be just the next step in, and not the end of, an investigation.
The article itself said that there was a DNA hit and the victim ID'd her. Granted, the DNA was due to the ID theft issue, but as far as the NYPD had information, it was her DNA. Honestly, whats to get crazy about here? This isn't a 'sensational' case of police misconduct. Unfortunately these things can happen, and when it does, you get to see why the courts exist and cops don't convict, contrary to what people like Nybbler will always say.
What I don't understand is why NYC spent all this money (apparently) to send cops to Oregon to arrest the woman they thought was the criminal, when in the end when they found the real criminal, they only sentenced her to probation and no jail time!
Sounds like the whole thing was a waste of our money.

The NYPD also said the picture matched the suspect. It didn't, not even close. Either NYPD detectives are blind, or they knew the pictures didn't match, or they didn't even bother to check.
It sounds like it would make a good episode of HARRY'S LAW.
