I live in nycha in new York. My son is on the lease but he refuses to pay his portion of the rent. How can I remove or evict him from my home. I my health is poor and I'm tired of dealing with him. My wife and I can't take it anymore. Help!!!

I'd talk to a lawyer. I'm not sure the laws but it seems like even if they are on the lease but refuse to pay, they could be told to vacate. Or just wait till the lease is up and don't renew it, then move somewhere else without him on the lease.

He's on the lease? You may be stuck with him.

If he wasn't on the lease, and you were, you could evictor him, snice legally he would be considered a guest/sublettor. But since he's on the lease, he has as much right to be there as you do. The only person who could evict him would be the landlord. And the LL could only do that if there was a major lease violation (like the entire rent wasn't paid.) And in that case, he wouldn't, and likely couldn't evict just him. He'd do a full eviction and try to get you all out.

Talk to a lawyer. This is complicated, and I'm not sure what your options are.

Not a question of him being on lease or not. Once someone has been living in your home for 30 days, you can only get him out by having him legally evicted. You go to landlord-tenant court for that.

Do Not change the locks on him and don't throw his stuff out on the street. You will get arrested.

Is he doing anything wrong other than not paying rent? How old is he?
