I may need to leave my apartment 4 to 5 months early. I was looking to relocate to NYC when my lease was up but my mother (who lives there) has just been diagnosed with pancreatic cancer. The doctor said something like 70% of people pass away within a year. I don't want to wait those extra few months and lose that time with her. My landlord has a family and seems family oriented. I think she would be willing to let me out of my lease completely if I gave her enough time to find someone else (and maybe even help with that). But if that is not the case I'm trying to figure out my options. All the subletting laws I find seem to be for NYC, not sure if they are the same for all of NY. Do I have the right to sublet?
I don't think there really are any laws in this regard. As a landlord myself I would advise you to immediately contact your land lord, hat in hand and work this out without getting into the legal realm . It's not that hard. If you can give your land lord a FIRM date to be out, I'm sure you can work it out, I'm sure things will be fine. If you owe your landlord money, or in any way you have violated your lease agreement then I have nothing good to say to you.
