Is it a law to give time off without deducting pay or just good common practice? I am aware of a situation where the company deducts time off (any increment) if an employee has an appointment, not work related, outside of the office. However, said employer will not pay any additional salary if employee goes over the stated work week hours. It has been my experience, if the employee works over the agreed work week hours, they are not paid additional money. However, If the employee needs to take time off (not vacation) they will not be punished by deducting pay on the paycheck. I wonder if anyone has any information on this issue for the State of North Carolina. Also, if you could cite websites, etc. that would be very helpful.


Understand, I am talking about working 5 - 15 hours over agreed work week hours & getting deducted for as little as 30 minutes. This is not a case of employee abuse of time. This is an occasional issue but still an issue in the eyes of the employees. It would appear the employers are taking advantage of the employees in this situation but is it illegal?

Doesn't sound like it is compliant with the FLSA. The first thing you need to figure out is if you are considered exempt or non-exempt based on your job responsibilities. What do you do? If you are exempt, they can't dock your pay for missing work. If you are non-exempt, they have to pay overtime for > 40 hours a week.
