I am a Realtor in NC and specialize in new construction. No...you don't have to close until the house is complete and he can not charge you for the delay. You actually have rights against him if he doesn't close by the contracted date. I recently worked with some buyers that had contracted on a house and it was not ready for closing...we gave them another 2 weeks to complete a few necessary repairs, but the builder chose not to finish what we asked for so my clients got their earnest money back and bought another house. If you are having doubts about the builder coming back after the sale, then he probably won't. It happens way to often. If you are working with a Realtor, he/she should be helping you with these answers. Good Luck!

Never underestimate the power of the Realtor. Imagine what would have happened if there hadn't been one involved in the transaction.
