I'm just looking to ask a lawyer a quick question. Preferably someone with disabilities experience, but I don't have a clue about the world of attorneys so I'm not sure how that works?
If we have no lawyers here please send on over some recommendations in the Lake region....thanks

I have relatives that used Tammy Clause in Newfoundland a few years ago. That's the only one I can think of for now.

Use an attorney that doesn't know other attorneys here or who expects to run for Judge or needs favors. If you need an attorney regarding disabilities, with respects to schools, you need an attorney that specializes not only is disabilities, but school law as well. School law is a seperate entity in itself. Many local attorneys here are afraid to go after school districts, etc. so you have to find one that specialized and one that is also familiar with due process hearings should the need arise.

Try to get someone that is not in the immediate area otherwise they advise you wrong or are friends/cohorts of opposing counsel.

There is one I would definitely say away from the lake region, but I will send you a dm

Havent got the official answere yet but poking around the internet showed pretty much what i think is the answere as typing in autistic and fence brings up lots of the same issue. again this is what im guessing it all amounts to, im not a lawyer . the disabilities act only covers public places, hotels,restaurantes. there are no provisions for residential issues . communities with covenants pretty much dont have to bend. the burden is placed on the person with special needs to be in a residential enviornment that supports what they need. that means a private home not a community where the rules of the covenants interfere with the needs.

its like a heart disease victim living on the 4th floor of a walk up building and there is no elevator. its just a poor choice to live.

its really up to the boards unfortunetley and is more a moral issue rather than a legal one as far as whether they will bend the rules.

spoke to my son. yes the disability act does not cover residential . however each state my have its own little laws about being accomodating to people who have various issues. where he practices law here in new york there is a ton of them. they just handled a case where a woman with mobility issues requested a ground floor apartment if one became available. she was on the 3rd floor now. they gave the apartment to someone else and she sued .


bottom line is each need is entirely on its own and each state different so you will need someone familiar with pa law. just get doctor notes and all the support you can muster to send in with your request for a fence.
