State AG’s office probes lawyer arrested for DUI

The state attorney general’s office is investigating one of its senior staff lawyers who was arrested last week after allegedly driving intoxicated and fighting with police, an office spokesman said.

Scranton police arrested Scranton-based Senior Deputy Attorney General James P. Kearney, 56, of Clarks Summit, on Oct. 24 after he allegedly failed a sobriety test and yelled obscenities at arresting officers, telling police, “I will kill you.”

The attorney general’s internal affairs unit started reviewing police files this week for the investigation into Mr. Kearney’s arrest, attorney general’s office spokesman Kevin Harley said Friday.

Attorney General Tom Corbett will review the investigation findings when they are complete and will consider disciplinary action, Mr. Harley said.



According to the police affidavit, just before 1 a.m., Mr. Kearney crashed his black 2009 Hyundai Sonata into a utility pole in the 800 block of North Keyser Avenue. Officers who arrived at the scene said Mr. Kearney slurred his speech and could not stand up.

When asked for identification, police said Mr. Kearney fumbled with credit cards from his wallet, then displayed credentials from the attorney general’s office. He then suggested the incident could be taken care of and there was no need for police on the scene, the document states.

Mr. Kearney could not complete a field sobriety test, according to the affidavit.

Police took Mr. Kearney to Mercy Hospital to have a head injury checked and have his blood tested for chemicals. When police told Mr. Kearney he was under arrest, he became disorderly and noncompliant, the documents state, requiring double-locked handcuffs and several officers to place him into custody.

At the hospital, Mr. Kearney continued to resist police, “cursing and screaming all the way into the examination room” and refusing chemical testing, the document states.

As officers and Mr. Kearney waited for a scan to check his head injury, he allegedly told three officers, “I’ll have your jobs” and “you don’t know who I am.”

He told two officers he had guns and would kill them; he challenged one officer to a fight and threatened to physically assault him when he was out of handcuffs, the document states.

Mr. Kearney was charged with driving under the influence, terroristic threats, resisting arrest and disorderly conduct. He will face a summons by mail."Come on people?? A Summons, by mail???" HE should be in jail waiting for his hearing!!!

Scranton police Lt. Jeff Mackie, who was at the accident scene, said while it can be uncomfortable arresting fellow officials, they are not above the law.

“He should know better,” Lt. Mackie said. “Getting in a crash and giving our cops a hard time is unacceptable. He should know this, especially being in the law enforcement field.”

Mr. Harley could not confirm whether Mr. Kearney has returned to his office on Penn Avenue during the investigation. "What about Jail Time??"

Mr. Kearney has worked in the attorney general’s office 20 years and is assigned to the civil division, Mr. Harley said. He is one of about 200 attorneys employed by the office statewide.

I must say this is going down in the book's! A DUI, "refusing chemical testing"? One year right their no more driving for him! HA HA!

All them charges and NOTHING?? No juge?

Can anyone besides me see that this guy will get nothing in the end?? But maybe a little "disciplinary action".... What a joke!!!!!!!

Scared of what? This is how it is. In NEPA its who you know and thats why this guy is going to walk... It all gets swept under the rug when it comes to those in gov't or those connected to gov't. I'm not sure why your surprised by this, this is the norm.

anyone else with those charges would be in jail or atleast have a decent bail set. Looks like this guy didn't get anything.. A summons by mail! Whoop de doo!

Your right! It's not just around NEPA, it's everywhere. But here's the big problem. What happen's when another person get's the same charges, or close to the same?? Is that person going to get the same get out of jail free card???
