@mrskay - I-797's don't necessarily have the H4 spouse's name, so that point is invalid. OP cannot produce what is not given.

I fully sympathize with the OP's situation - I've dealt with NJ DMV (and long ago California DMV) where some of the officials in there didn't know their @ss from their elbow and kept interpreting the rules differently (which is why this topic makes me so angry ). USCIS and DMVs... two of the absolute worst departments that you can possibly deal with.

I looked at the VA DMV document requirements. Your problem is the second ID (the first being your passport with visa and I-94), and almost everything in that list is for US citizens or those with prior issued Virginia ID's. I also noticed that the document does not mention a foreign drivers license (translated or otherwise) as a valid secondary ID, but clearly they're telling you that it is. Utterly idiotic.

- Do you have an Indian drivers license? If so, you might have better luck with the Indian consulate.

If not, maybe you should hire an attorney and take it up with DMV. This is utterly unfair, and you're being punished for no fault of yours.

Perhaps comprehensive immigration reform should include a path to a VA drivers license.
