Tell me how an attorneys office gets away with putting a deployed soldiers house in a sheriffs sale?

My wife has been trying to get a hold of the bank and this attorney since I left for Afghanistan 6 mos. ago. Now my house is in a sheriffs sale for next month. I am protected under the Soldier and Sailor Servicemember Relief Act, but they are still continuing with all of this. We do not want the house anymore, one because we paid too much for it and it is just too small. But the fact still remains that they are ignoring the fact that we have all the money to pay it up to date and I am deployed!!!!!

Can we still let the house go?

I'm no expert on this but I did a little research. It appears that there is a procedure that needs to be followed on this, it is not automatic. It also appears that this provision is to reduce interest rates to not more than 6% in order to make the mortgage payments manageable. You state "we have all the money to pay it up to date". Have you been making payments to stay up to date or not since you are deployed? Here is the site I found these points.

You need to get a good real estate attorney to fight back. If you need the name of one I can get one for you. I wish you good luck.
