As a Hearthstone home owner, I received the notice of Chapter 11 Bankruptcy Case, Meeting of Creditors, and Deadlines letter. It makes no sense to me. Does anybody know what homeowners are expected to do as a result of this letter? We moved into our house in October 2009 so most of our warranties are out excluding some of the major items like foundation and waterproofing. Does anybody know who will cover these warranties?

First, all filings in the US Bankruptcy Court are public records and can be accessed via the individual bankruptcy court website. It is NOT free but is relatively inexpensive.

In bankruptcy, the creditor may be allowed to walk away from the obligation or may decide to reaffirm. That will eventually be the decision of the bankruptcy judge.

If you are having SPECIFIC warranty issue prior to the filings, I would file a claim. Otherwise, I would sit put and see what the results of the filing are.

Of course, I am not an attorney nor do I play one on TV. If there is a substantial amount of money involved, please spend a few dollars to consult a attorney familiar with bankruptcy law.
