Well, who knows exactly what the facts are but if the "victim's" facts are true then the cop deserves to be charged and sued. Of course the "victim" was in the wrong for nearly the entire night (e.g., causing fights, vandalism, and etc.) but to shoot him for that is an unbelievable over kill. Tazer him, yes. Shoot him, no.

Plus, and again this is based on the shooting victim's facts, he was getting into his car and leaving. And apparently one of the cop's stray bullets lodged in an adjacent apparent complex.

I'm usually all for tough police action but this was really really stupid and really really dangerous.

Now, if other facts come out to support the cop's actions, like he thought he saw the victim with a gun, then I'll completely reverse my stance. However, by all accounts thus far the cop was pretty out of line.

That doesn't mean the "victim" shouldn't be sued and punished for his actions. However, the cop should also face the consequences of his wrongful actions.

I agree with you. If the officer had reasonable evidence to think the 'criminal' had a gun, and he thought the sound of breaking glass was the result of a gunshot, then there should be no problem.

Otherwise it was blatantly wreckless.

He won't be charged....maybe found reckless. Cops usually only get busted if it's on film. I guarantee he won't lose his job.

Just saw a newscast this evening, and guess which Bozo was grandstanding with the "victim" outside the bar?

JMD smells big money here, and he's looking at a sizable cut. You know he's going after this one like a dung beetle on a turd.
