About two months after we had sign a years lease. Our land lord starting sending emails saying we they had been turned down for a refinanice on the home and were looking at their options. We had no knowledge of this when we signed a years lease. We were looking at this to give us a year to get back on our feet so that in a year we would be in a better postition to move. After several e-mails back and fourth over less that a months time period we were told we were going to have to move. As soon as possible. Then in a few days that became we had to move in a month then two weeks. With only one income, my wife has a location sesative type of work and had to tell two potential clients that she could not work for them. We did not have the means to move at the time and I had just started working a shift that would allow for us to start working on isssues that concerned us renting else where. We had started out just renting a room to renting the home when the landlord moved back east. After some e-amils back and fourth with us explaining we did not have the means to move. They offered us the money to move as a loan. feeling we had no choice we took it. We took part to purchase a vehicle to help since all we had was a motorcycle. Good thing we ended up living in it for a short time. Over $500 in application fees to find out that not only had someone used our identy but many other issues we were unaware of. We are coming up on the pay back date. We are wondering what our rights are. My wife has still be unable to find work and I am both working and going to school.

You need a lawyer - contact Legal Aid or someone who specializes in landlord-tenant issues who will give you a free consultation. Several questions come to mind: Did you sign a promissory note or some kind of repayment agreement for the loan? If there was not a written agreement, you might have an excellent argument to not pay it back. Did you have a deposit on your rental that was not refunded that can balance against the loan amount? Did your lease agreement allow them to cancel the contract early? You actually may have a claim against them. Again, see a lawyer

Any idea where one would find a lawyer for this issue? We did not get our refund back but it was a very small amount since we started off just renting a room. We did sign a promissory note but it was not noterized or anything and I will have to look at our lease. Thanks for your feed back , I really appreciate it.
