so if you recieve a check 3 weeks after being laid off and filing unemployment but it was not a commision check but an employer who did not follwo colorado law and pay final check at layoffs.. do you report this income if it was earned prior to filing for unemployment...

I made a call to day to colorado unemployment office and if monies were earned prior to being laid off it does NOT matter when you recieve the income you do NOT have to report the income period if earned prior to discharge of job.

Supermom81, thank you soooo much for posting this question and then following up with what happened after you called Unemployment for info. I am in this same situation, although live in California. I have been SCARED OUT OF MY MIND that suddenly these commissions would come back to haunt me now that I'm waiting to get my second benefit claim filed. It's been driving me insane, thinking I was out of both work AND now, perhaps unemployment--and for a misunderstanding.
I pray that the laws are the same in California. I have a scheduled phone appt. this weekend and will update this post with what happens.
