I have a lease on an apartment in my name only,my husband and I were seperated at the time ,since then he has move in with me and his name was not on the lease ,they are now aware he is there an request that his name be added,when they ran a background check on him it was not favorable to them so they said he could not be there, Can they do that make him move ? and if I move out do I have to finish paying for the remaining of the lease.

You signed a legal contract to complete (I assume) a 12 month lease. Your husband did not. They have every right to deny him tenancy based on an unfavorable background check, and they have every right to hold you to the terms of the lease.

If he stays, you are in default. If you leave, you are in default.
