Do people ever get injured by being splashed with water at a pool?

I really don't get why people who are at fault for others injuries should not be held liable. Like if you crash your car into somebody and injure them... obviously you didn't mean to do it, but intent doesn't negate the fact that you caused damage and harmed a persons life.

Children I believe are allowed to ski but they have to take lessons and pass a test I think, and please correct me if I'm wrong...but only then are they allowed to ski the bigger slopes....I don't know the whole story, none of us do, but, do any of us honestly think the boy hurt the man on purpose, if he did, or did the man fall and use the boy as an excuse to receive compensation? Only the man knows...

no, I haven't heard of anyone getting injured while being splashed, I was simply making a joke.....to show how insane this all is....

the whole subject matter of this, is the point that people honestly get away with suing for stuff like this....

and as far as an accident is concerned....no, the person who made the mistake and hit the other car certainly doesn't mean it...but I tell you this...when you are severely hurt by an automobile accident....and need hospitilization, medical bills, perscriptions, and loss of work from the injuries....yes, indeed the person should be held liable, but that is a whole different issue.

I'm wondering why in the world, in this day and age, judges do not throw these ridiculous law suits out of court?

Can anyone answer that...? I've always pondered that?

Reminds me of a case not long ago in NJ where a doctor was bicycling and an 11 yr old girl was rollerblading and the two collided (same direction if I remember right), long story short the doctor sued the girl, the case was tried and he lost (it all happened very fast, he warned her by ringing his bike bell, she turned around and tried to get out of his way but wasn't fast enough, he fell and needed shoulder surgery), the girl was ok but bruised, they concluded he s/h braked or ridden around her.

I live in Colorado - my son has skied since 5 years old. No, they are not required to take any sort of lesson and there is nothing to keep them from being on the bigger slopes.
That being said, no parent would want their child skiing the bigger slopes without being ready for it.

he's suing to pay his wife for her medical "services". the whole thing is sketchy and I would have had the man arrested for assault for grabbing my child.

Skiing is an inherently dangerous sport. The lift ticket you buy usually has a statement that holds the ski resort blameless. Most resorts (and I haven't skiied Beaver Creek in years) do have policies that you must ski under control and must overtake down hill skiiers in a safe manner.

Without comment on the specifics of this case, there are many kids on the slopes today who ski too fast for conditions, who jump without adequate downhill visibility and who are not supervised adequately by parents to ensure they are skiing in manner that is both safe and courteous. I myself was knocked flat on my back,my skiis knocked off by a child (maybe 12-difficult to tell with all that gear) who "took some air" on an intermediate slope clearly marked NO JUMPING. The child stopped briefly, did not apologize, did not ask if was ok, did not help me get up! The most amazing thing was the mother who skiied up behind the kid, also did not apologize or ask if I was OK! The apple does not fall far from the tree. If there was a ski patrol person around, I would have tried to get their lift ticket yanked for skiing out of control, and being a jerk in general!

I was involved in a similar incident where i lost control and ran into a group of skiers. I was not only sued and had to pay medical expenses and time off, but actually got a TICKET issued be the local police for FAILURE TO CONTROL. I hated it, but realize it was MY resposibility to control myself.

It doesn't matter that the person involved causing the ski accident was a child. A ski accident is no different than a car accident as long as they can prove the case/law suit for injury. The lawyers are the ones who win big in these cases.
