Charleston, VA (AHN) - A Wyoming County man who says he is constantly worried about his health after finding a condom in his iced tea glass last Mother's Day is now suing the Shoney's restaurant in Logan and the company that operates it.

The lawsuit filed Thursday says that when James Bledsoe saw a condom in his drink he "immediately became horribly ill, dry heaving and nearly vomiting at the table. He then ran for the nearest restroom to vomit."

According to Associated Press reports, Bledsoe is suing the restaurant manager, assistant manager and the server who waited on them for an unspecified amount in both punitive and compensatory damages. The incident took place on May 14 when James Bledsoe, 30, saw the unwrapped condom in his half-finished drink while dining with his family.

You mean he drank half the glass before he noticed this thing in there? If it were me, I would have seen it right away! That's just nasty!!!

Okay, so he had an iced tea at a Shoney's restaurant. I believe they serve the iced tea in a glass with no lid on it. Wouldn't you see something as large as a condom floating around in your iced tea - BEFORE you drink half the glass?????

maybe it was a new flavor of ice-tea... called ....tallywacker tea, 96.6% effectiveness, not to give you cankers, or cold-sores..around your mouth.

Does sound like a scam...I don't know any drink where you wouldn't see a condom...unless maybe they put it in, filled the whole glass with ice, and then put the drink in (but then he'd have finished the whole thing before seeing it, and it wouldn't be floating)....hm.
