My daughter was visiting her dad with his new wife and based on what my daughter described they were using drugs in front her. Her father is definately a crack addict. I have contacted the poilce they told me to get a lawyer. I WANT THEM ARRESTED!! What can I do?
Get a lawyer today and let him/her walk you through this process. Of course you have reason to have visitation revoked! And In your shoes I would also want them arrested.
But I agree with Mike, focus on your daughter and let her see how rational and calm you are while protecting her best interests. She wouldn't have told you about it if she didn't know it was wrong and that it made her uncomfortable! So you are already on the right track!!!
How old is your daughter? If she's over 8-9 I'd equip her with a cell phone and have her call you and/or the police next time it happens. She can hole up on a bathroom or her room till the police get there.
BUt your first responsibility is getting your custody arrangement changed, that's why the cops told you to call an attorney.
Yep you should get your custody arrangements changed and if they want to know why then state clearly drug abuse . Yes most def if I knew for sure my ex was a crack head I sure as bleep would not let my daughter go to his house . You need to see your lawyer who did the orginal paperwork and custody agreement . Good luck I know this cannot be easy for you .
Also, the police can't just arrest someone based on something they heard third-hand. Third hand meaning:
1st hand account: the person doing the drugs reports himself to the police.
2nd hand account: someone witnessing the drug-doing reports to the police.
3rd hand account: someone witnessing the drug-doing, reports it to mom, who reports it to the police.
You have no evidence that the father did any drugs at all. You have the word of your minor child. While your child might be telling the total 100% bonafide truth, it isn't evidence of a crime, and the police can't just go to his house and arrest him based on what someone told someone else.
And so - you need a lawyer.
