It should be obvious the difference between bath time photos and a child being sexually abused.
Also what pedo is going to get his kiddie porn developed at walmart?

I am all for laws that protect people and children but anyone working for walmart shouldn't be able to determine that.

No steps should have been taken BEFORE they determined them to be pornographic.

Steps were taken to let the AUTHORITIES decide if they were pornographic, Walmart employees didn't make that decision.
And yes, criminals, especially amateurs, are that freakin' stupid. You would not believe the stuff that people want developed without thinking about the employees that have to see those pictures. It's actually funny when you see some of them realize that it's not some anonymous, totally automated process.

I can actually agree with you that people who report suspected abuse of any kind should be off the hook. I think the employees were being asinine to jump to that conclusion, but I wouldn't agree with legal consequences.

However, everything that happened AFTER the pictures being reported does deserve legal consequences. There is a complete lack of common sense and accountability in our legal system and in the CPS in particular. These parents and their children suffered because a number of trained professionals failed to use any discretion or common sense.

This is the flip side to the many recent cases of kids being suspended for gun shaped pastry or army men on cupcakes at school. There are no longer shades of grey...an army men with a rifle is treated as if it were an actual gun. An innocent naked picture of a toddler is treated the same as porn. It's like our society has collectively lost all ability to understand nuance or situational awareness. I honestly believe it's a form of collective insanity.

I agree. I certainly have pictures of my kids in moments of undress or in the bath, but this might have been a bit more than that. They said there were pictures of three of them nakes, laying on a blanket, all hugging. Not sure why there is someone taking pictures instead of trying to get them dressed? The fact is, there are sickos out there, and its normal to report something you find suspicious. The article said:

"In order to convict a person of a crime of sexual exploitation of a child, you have to show that the intent of the photographer was to sexually stimulate the viewer. All the experts agree that even police officers don't have the authority to make that decision," said Treon. "So, we argued that Walmart was negligent in setting up this program with untrained clerks and giving them tremendous power over the lives of their customers."

well, yeah, duh... When was the walmart employee given the power to convict them?? When were the police? Where they ever convicted... no. Walmart reported suspicious activity, which is common sense. The police notified CPS, which is policy. I'm sure the police also investigated, and either decided not to elevate, or the DA decided not to seek prosecution. So no, nobody was convicted. The bull about having to give a disclosure that they could see your pictures, and report inappropriate pictures is just plain retarded. Why would they have to discose the obvious to you? I've seen people's pictures being developed while I was standing in line waiting for mine (centuries ago, that is), I've never assumed total privacy.

Walmart didn't determine anything, they reported suspicious activity. The pictures were never determined to be pornographic.

Yup, criminals have been caught in this exact same way, so yes, they are that stupid.

Pretty stupid of the parents to get naked photos of their kids developed in a place like Walmart, it stands to reason that the employees would have to report any photos that show children's genitals, you need a blanket policy like that because it would be far too difficult for an employee to make the distinction between an innocent picture and a possibly pornographic one and they shouldn't be expected to try and decide that.
Feel sorry for the parents though, its horrible to be suspected of something like that, I know because my ex's dad accused me a few months ago of physically and sexually abusing my toddler though thankfully the child protection workers and police figured out immediately that his claims were bull****.

On the subject of common sense. I know this is 100% not pornography. No question about that. But why do so many parents love to take these type of photos of their kids anyway? I've knows lots of people who love to take nude pictures of their kids while they are taking baths or running around the house, but why? I don't get it. They can't think of any more interesting time to take pictures of their kids? Like while they are playing ball, or having a birthday party or something? I'm surprised some parents don't take pictures of their kids while they are taking a crap on the toilet.

Plus then take the film to Walmart to be developed, where a minimum wage worker could then potentially duplicate the pictures, and distribute them on the internet for the enjoyment of pedophiles. Are these people really too stupid not to have heard about the invention of digital cameras, or something?

Film processors in many states and within many companies are mandatory reporters. If they don't report they are breaking the law.
