A Maricopa County Superior Court judge ruled that the photographs were not, in fact, pornographic, and a medical exam revealed no signs of sexual abuse. The girls were returned to their parents.

If you're arrested for a crime, even if they figure out a few hours later that it was a paperwork error and release you, the arrest stays on your record forever, unless you want to pay a lawyer a couple grand to get it expunged.
OMG!!! There but for the grace of God go I. I have a picture of my dd at about 1 1/2 in her kiddie pool. I never noticed at the time but she was sitting with her legs apart and you can see everything God gave her under the water. As a mom, I focused so hard on my kids faces that it would be years before I'd notice that.
This is insane. However, this couple will lose. You can't sue someone for reporting you for suspected child abuse unless you can prove it was done with malice. I don't think this was.
It's too bad that the couple and their girls had to go through that, but it is important to use some discretion when it comes to your children's photos, what's in them, and who sees them. With digital photography it's not such a big deal anymore, but I think a parent should know better than to take photos of their children, no matter how innocent, with their private parts showing, then take those photos to a photo lab for whoever to see them, post them online, or any other method that would require anyone outside the family to see them.
The workers at Wal Mart are just ordinary people, not trained professionals. All it took was one person to be uncomfortable with those images for this family's life to be turned upside down. I don't think this family did anything wrong, and it doesn't sound like there was anything wrong with those pictures, but all it took was that one person to think that there was for this to happen. I think the parents should have used better judgment about their children's photos, but I DO NOT think they should have had to register on a sex offender list or their kids should have had to be examined. Maybe the people at Wal Mart didn't know any better, but social services should have known and dealt with enough real child porn to know the difference between that and innocent bath pictures.
I remember watching A Baby Story when I was little and seeing little naked babies doing various things. Since I only have a sister, her and I would say "ewwwww" anytime a little boy was on the screen to which my mom always replied "It's just a baby"

That's how it works with CPS cases. They are not held to the same standards that you can expect as a citizen, in a regular court of law. The "burden of proof" is totally different. There are stories and stories of people who were investigated for suspected child abuse/neglect, a court of law found no evidence of abuse, yet the parent(s) names remain on a central registry, preventing them from working with kids, adopting, etc. The CPS agencies are not required to "prove" anything before declaring that a child has been abused or neglected. They pretty much just decide yes or no, "reason to believe", etc. It's nuts.

Any program we have here in the US is so seriously flawed that it isn't funny. The legal system is corrupt, CPS spends more time investigating things that are nothing and little time investigating the cases that should be looked at.
I filed a report with CPS once and nothing happened and there was ACTUAL abuse going on, one kid turned 18 and got out and is seriously messed up in the head and her 4 other siblings still live there and are still going through things they shouldn't be going though.
I think people are idiots, whoever reported those pictures had to be pretty stupid.
Clerks are not making those decision simply because of personal feelings, they are told to report all child nudity that exposes genitalia.
Mgt is notified and the decision as to whether or not to get authorities involved is made by upper mgt. In our store that decision is made by district personnel. I don't think any big retail store would be crazy enough to let simple clerks call the shots on such a sensitive issue.
