Am I wrong, and does anyone know if in NC ....that when a child drops out of school at 16 and starts working, child support should end?
Step son dropped out at 16, at the time began living with us and working.
For the last 1 1/2 yrs we've been paying (close to what we pay for our house) for a child that lives with us and has been out of school since Jan. 07, and working full time.
Technically, I know we should have stopped when he came back to live with us, (although this has nothing to do with courts)but shouldn't it have stopped when he dropped out of school. (The school would know a date of last attendance). DH HATES dealing with this issue, pays just to avoid sitting in court. Plans on hireing a lawyer a few months before 18th b-day (which is december) which of course is more $$$$ just so he knows it legally stops ( won't listen to me that I believe they owe US money for overpayments.)
He works longer hrs then they, and I don't believe they will talk to me as I am just a step mom with out legal papers to state he lives with us.
Anyone have any idea how i should handle this?

The payments should stop as soon as he came to live with you and as soon as he quit school - but you have to file - I don't think it's retro active - at least it's not in PA.
Your husband will have to call the office....

I don't know about NC, but in my divorce decree the only way child support stopped was when they reached the age stated in the decree. Attending school was not requierd.
At the point the physical custody changed, it should have been documented by the courts and child support changed at that time.

i wish there was a way to find out if it is retro here in NC, I know someone who was "refunded" money from child support for over payment, but not sure of the reasons behind it. He didnt know anything about it until he recieved a letter and a check.
Not that it really matters, (see it doesn't involve the ex) it's all good. looking forward to 1 less (big) bill a month, especially with the way gas and groceries are going up.
He has FINALLY filed a motion to modify.
