Yes. Sadly, I doubt anyone will give us a chance to vote on it. Instead, our politicians will continue to decide for us, regardless of what the majority of the people want.

Yes to all, although legalizing marijuana for recreational use will be instantly attacked by the federal government. Maybe the Supreme Court will finally put the issue to rest.

It should be interesting. I doubt the federal government will go after it while Obama is President. There were already local governments in Colorado that had fully legalized marijuana, and the federal government didn't do anything. When Obama went into office, he signed an executive order saying that federal government would not impose upon state rights on this issue. There have been a few incidences where the DEA couldn't control themselves, but overall, they have done a good job of staying out of it compared to previously.

State legalization of both medicinal and recreational marijuana does exceed state bounds because it directly conflicts with federal law. I don't think the DEA needs Obama's express permission to file suit in this case. In any event, I think it's important for the Supreme Court to resolve the matter one way or the other so that dual federalism continues to mean something. I personally think Gonzales v. Raich is crappy precedent that should be struck down, but until the Court says otherwise, it does control in this case.
