My landlord has recently tried to evict me about a month ago. We went to court and the judge has said that since we have been paying him the rent in intervals and all paid up, there is no grounds for an eviction. So to all my knowledge the case has been dropped. But suddenly, 2 weeks later we have received a letter on our door from a constable, basically stating that we must vacate the premises and that the landlord has the right to vacate the people in the home, (I'm paraphrasing by the way). I'm completely mystified by this? Everything went well in court we won the case, so why am I getting eviction notice? Is this legal? Was there something he could done or lied about to make this possible? Again I'm completely mystified, he is saying things like if we pay him all this money for court fees that he will drop it. But I'm thinking drop what? What is there to drop, there's nothing going on, it's all over and it's all taken care of!

So it comes down to this, do I pay him the $150 in suppose legal fees that I'm by law bounded to pay him,

OR

Any ideas?

P.S. Are rent was late by 2 weeks and a week later we received the letter by the constable, so in retrospect I guess it was 3 weeks since our last court date. What does all this mean? What does it apply? What can we do about it?

We appreciate any insight into this situation.

Maybe you should willingly move. Your landlord obviously wants you out. He's not going to make your life easy. Do it for your own peace of mind.

Agreed. I don't quite understand why you'd want to stay in a place where you're obviously not wanted.

Your facts aren't really clear. So, you were facing eviction but came up with the money in time? Then right after you were late with the first rent payment?

I would get a copy of the order of court dismissing the case. You may not have understood what the Judge said and it may been something else.

And your lease probably says either party can cancel it with 30 days written notice.

A tenant that isn't paying the agreed upon amount on the agreed upon date, is commonly going to be let go.

I'm thinking this is what is occurring.

Take the eviction notice to the magistrate.

The magistrate will straighten out the constable and the landlord if they are wrong.

If they're not wrong, he'll tell you so and you'll need to move.

This is the fastest way to find out where you stand.

I can understand. He may not have the money to move right now. Moving requires security deposits and truck rentals.
