I hope someone can help. In Sept 2011, my employer offered me a wage package because they were in the process of selling the company and wanted to make sure that I stayed until the end so other employees wouldnt't leave.
The agreement was that I would continue to work and that at the time of the sale, when the sale was concluded, I would receive $100,000 earned for staying on.
That payment was made in the 4th quarter of 2012. The new owners laid me off.
Now, that $100,000 payment, which was "earned" during 2011 and 2012, is all being applied to my 4th quarter of 2012, making me financially ineligible for unemplyment.
How do I present this to unemployment, to allocate that payment to the period in which it was earned and not the period that it was paid.

You received a bonus, not money earned over a period of time. They go by when bonuses are paid, but you could luck out. The only way to present this is to provide unemployment with copy of the contract you signed in September 2012. In the meantime, start looking for work because that 100k will be your highest quarter until April 2014. If you're denied unemployment, you'll need to save part of that 100k for your own personal unemployment fund for the next 12 months. You don't want to live off of it all right now because you might need it sometime in the future 12 months.

You can always appeal your UC-44F. Do so within the 15 day appeal period or you cannot address your concerns. PA UC Law specifically states wages are reported in the quarter they are paid, not earned, according to the employer's UC-2A. (See Section 404 of the Law). In your appeal you can argue to have it changed and explain your reasoning to the Referee. PA UC Law <-- opens as a .pdf file.

You should also be aware of some changes. You now have to have 49% of your base-year wages outside your highest quarter. It used to be only 20%.
