My mother died without a will. She was living in Perry County (Duncannon) at the time but had real estate in Snyder County (Selinsgrove). She only has a small estate, a house that might be worth a little bit. Maybe we'll get $30,000 if lucky.

It's my understanding you file with the court (probate?) in the county of residence, Perry County?

We have retained a lawyer but haven't met with them yet. We're not sure that we NEED a lawyer.

I understand I have to go to court to "open" the estate. That will be a burden because I live in North Carolina. I have a brother who is much closer but I'm not sure he's willing to help.

Frankly dealing with everyone's personalities is exhausting.

Hiring an attorney is necessary when someone dies "intestate," that is without a will. The probate court then appoints an executor or personal administrator to go through the motions of settling the estate. The executor is given "short certificates" so he can close on the sale of real estate, bank accounts, etc. The executor is entitled to reimbursement for expenses incurred including travel expenses. How do you know that your mother's estate is small? She may have savings or checking accounts, life insurance policies, 401Ks or money socked under the mattress.
