Me and my two other roommates signed a lease together for an apartment a year ago but the lease expired a few months ago and we have been paying month to month for about 3 months now however were all still on a month to month lease and only my boyfriend is financially liable because our other roommate couldn't get approved, but he's still on the lease. A few days ago we all signed a document saying we'd be out by Sept 31 because we all agreed to move somewhere else "together" but really me and my bf just wanted to move out and ditch the guy because he's super annoying and never pays rent on time, so we told him we wouldn't be moving in with him after we got him to sign the document and turned it in but now the guy is acting like he has nowhere to go and he has been given 30 days notice since we told him immediately after turning the document in, however if he doesn't move out of the apartment by the 31st my bf is the only financially liable person that means he would get charged if the guy doesn't leave. That all being said the guy is most likely not going to leave because we've had many problems with him and he's just irresponsible, so when the 31st comes if he's not packing up can we just take his stuff and kick it out of the apartment so we don't get charged another months rent at this apartment? What can we legally do if he doesn't leave? we don't want to be financially liable for him once we've already moved out.

Is September 31st like a Leap year that comes every 4 years? j/k If I was a betting man, you gave the required notice and are done with responsibilities Sep 30th. If the knucklehead does not give his vacate notice also in a timely manner, he would be responsible for all of the monthly financial commitments to the landlord. I would schedule your utility disconnects and ensure your roommate is well aware that he will be living in the dark. I also would have a talk with your landlord and explain the situation and let him/her know you want to do what is right. Unfortunately you may have to do the o'l switcheroo and welcome him to your new place and them kick him to the curb a week later to get him out of your current situation.
