A brief background... I am Canadian and over the years I accumulated about $18,000 in debt in Canada. In recent years however I have been in and out of Canada, and currently am in the US and am waiting to finalize my status as a US resident now that I am married.
I haven't worked in at least a couple years, and currently cannot work in the US as I am waiting on my status and social #. As a result i haven't been able to keep up with my credit card payments in Canada. I am now 6 months behind and on the verge of going from collections to the legal department of the Bank/Credit card company.
My question is... I have no assets or income in Canada. I do have some money in the US which I use to live off. Without it I'd be homeless. I do want to pay off my debt in Canada when I can, but currently cannot. Can the credit card company (Royal Bank/Visa) do anything to me or my assets in the United States or can they only "attack" me in Canada? Would bankruptcy be an option in Canada? Could I file bankruptcy from the US thru means of a power of attorney in Canada?
