I am living in NY.

I have been collecting unemployment, and started an unpaid internship. I was awarded a stipend from the internship but they need me to fill out a W9 and will mail me a check. If I collect this, will I still be able to claim benefits? How do I account for the stipend when claiming benefits?

I don't think it is "unpaid" if it generates an income. A stipend is income.

That said, how are they paying this? If it is only payable at the end, you may be able to continue to collect.

Why not ask the unemployment office?

If the stipend is treated as income your weekly benefit amount will simply be reduced, but possibly only by half of the amount you are making. Unless its a full-time internship, in which case you will probably lose all benefits because you can't be searching for fulltime work very well if you are working fulltime already. But each state is different, you need to talk to your state unemployment office.

1) we don't know the poster's gender



2) an internship IS work.



3) its neither illegal nor unethical to collect unemployment if you qualify within the law (and the poster may or may not qualify)


4) its also none of your business and not up to any of you to decide. You are not the NY unemployment office

In ny if the stipend is more than 504 a week you cannot collect ….ny cuts your unemployment based on hours you are working or consumed whether paid or not . The stipend is considered your pay

Up to 5 hrs is no reduction .

6-10 is a 25% cut

11-20 hours is a 50% cut

21 -30 75% cut

31 or more no unemployment

The crazy thing is the cuts apply only to the state unemployment, the 300 federal gets no cut .

But 504 is the max you can receive in pay or stipend and then you get nothing

If you earn 505 you lose every penny including the federal just for that one buck

I'm going to ask a different question. The OP brought up the W-9 form. It is my understanding that this form is not filed with the IRS. Isn't it just for the company, or whichever entity involved, to prove that they asked for his SS or Taxpayer ID number? Is, or should, the OP be afraid to fill it out? This form doesn't have anything to do with them reporting the amount they paid, right? That gets reported a different way anyway. The OP seems like he is worried about filling it out, but there seems to be no reason to be concerned. Right?

They report the stipend on a 1099- misc or even a w2..it can be reported both ways.but it is reported

That's what i meant. He has noc reason to fear filling out a W-9 since it will all be reported anyway. The problem is not the W-9. The problem is getting paid and trying to avoid reporting the money. The only way is to not get paid more than he is allowed to earn.

Yes , the w9 is not the reporting document on his end .it is on theirs .

It is also a case of the reductions in unemployment here based on hours not just an amount .

There are two moving targets ..going over 504 a week is one .

The other is you are only allowed up to 5 hours of work pay or no pay with no reduction and then it follows the reduction schedule until it is phased out at 31 hours.

Once your hours are consumed and not able to earn more than the 504 they take money off your unemployment….unemployment here is based on a four day work week so that is why at 31 hours you get nothing
