Hi all,

Can I still claim non-residency in Philadelphia if I am registered to vote in another state, have license there and own property there? If I were move and reside in Center City of Philadelphia (indefinitely but I want to maintain residency to go back when I can) but work outside of the city (in the suburbia), am I still considered a non-resident?

I know I would have to pay the state tax for all income earned in PA regardless, but for local income tax there is a difference between a resident and non-resident.

Any input is much appreciated!

You should be OK, as long as you use the other address with your employer and tax returns. Not sure of the legality, but it is tough for anyone to know where you actually spend most of your nights sleeping.

Employers are expected to withhold city wage tax for Philadelphia in the following ways:
- Philadelphia resident, working in Philadelphia - withhold at Philadelphia resident rate
- Philadelphia resident, working outside of Philadelphia, in PA - withhold at Philadelphia resident rate
- Philadelphia resident, working outside of PA - employer not required to withhold, employee would make payments to the city quarterly if employer does not withhold
- non-Philadelphia resident, working in Philadelphia - withhold at Philadelphia non-resident rate

Current rates are 3.924% for residents, 3.495% for non-residents.
