In the law it states that you may take time off for the care of a sick family member. Must you be the primary caretaker? It is not specifically stated.

An employee is looking to take off for a family member who is nearing death. He is not going to be the primary caretaker, but will provide some care. Would he be able to take sick leave according to the Phila paid sick leave law?

Any clarification you can provide would be appreciated.

Sick leave is required for any company with 1 or more employees in the City of Philadelphia. The law says that if the company has 9 or less employees, the sick leave can be unpaid. Sick leave is calculated by 1 hour per every 40 work hours accrued. Have you been tracking their sick time? My payroll company takes care of the tracking for me, maybe ask whoever helps you with payroll. "Earned sick time can be used for the employee’s own health needs, to care for a family member or for leave due to domestic abuse or sexual assault."
