6 Arizona laws limit HOAs' power

That is one of the new laws passed by Brewer, along with things dealing with signs, flags and some fees.

I think the biggest one is the parking on the street thing which in my opinion was good and bad. It sucked if you had an HOA that was super strict and if you had a party and cars parked on the street, they would ticket you...but at the same time I like when the street isn't lined with cars on both sides. In the end though, it is a public street and they shouldn't be able to tell the general public where they can park.

Remember not “all” hoa’s have “public” streets, a good number of them are “private” and the city or state has little or no say in what goes on within an hoa with private streets. It will be confusing for some.

Good point, AksarbeN . . .

This new law will only add to the confusion as to what's public and what's private. For example, the streets in my small HOA are all private which is a huge savings for the city.

Never understood how the HOA's could charge you if you sold your home.

At least it's limited to 400 bucks.

Gotta say I haven't seen a lot of neighborhoods with private streets, is it normally in gated communities? I assume it would be posted if the streets were private streets.

Many HOAs banned some vehicles like dump trucks, septic service tankers, flatbeds and so on from parking in driveways. Since they also banned street parking, these vehicles were not parked in subdivisions. I guess it is now OK to park the honey wagon in front of the McMansion as long as it is in the street and not in the driveway.

Not necessarily, HX.

The "trend" for private streets became popular many years ago when local governing officials were attempting to economize by eliminating street maintenance, especially future maintenance in new developments. Not certain how far back this trends goes, however, I have a feeling most, if not all, streets in communities built from the late 70's are private.

Although my small community is "walled" with only one access road, there are no obvious indicators the streets are private but I know for a fact, they are. Definitely a huge expense for the smaller HOAs as street maintenance is not cheap.

Our housing area is not gated, but it's all private.
I noted that I never saw cops in the area and I asked one when I met him why they did not ticket cars that tend to park out in the roadways and he told me that the streets were private and he couldn't write a ticket even if we were drag racing.
He said the only way he could write a ticket was if the association complained in writing.

Depending on the kinda street you live on. If your house is located in a subdivision that has nice wide streets and the homes not so close together, then having cars parked out in the street isn't so bad. As many know there are many subdivisions where the developer put in the most narrowest street and placed the homes so close together. That being the case the neighborhoods are REALLY going to look crowded and unappealling.

A neighbor just told me that the street parking part of the bill did not pass. Can anyone clarify that? Nothing online yet.
