Where can I build a fence on my residential property? The Zoning Ordinance allows you to build a fence on your property line or any other place on your property. This does not assume that the sidewalk or curb is where your property line starts. To accurately determine where your property line is, the land needs to be surveyed.
The maximum height of a fence is 3-feet within the front yard setback. Beyond that point, towards the rear of your property, the height of the fence can be up to 6-feet in height. If you wish to vary any of these height requirements, you must apply for a variance (FAQ #5). There is an exception for lots on a corner. A visibility triangle for traffic safety purposes must be maintained. More information is available through the Planning Department and the Street Transportation Department.
There are other exceptions. In some cases, there may be a public utility easement (PUE) on your property for underground or overhead utilities. Please contact the Planning Department for more information.

This is a good question. Who owns the walls between homes in HOA's?

Whether there's an HOA or not doesn't matter in that question. The HOA doesn't own the walls between houses. Usually, the walls are right on the property line, so each neighbor maintains their own side, and should share the expense if replacement is necessary.

In short check with the city of Phoenix and your HOA (if you have one).

Perhaps the neighbor had thought about doing the same thing, but didn't want to pay the full amount. You never know until you ask. No one is forcing the neighbor to do anything.

I think it's pretty common for neighbors to share the cost of things like this.

It's typically a common wall on the property line that is owned by both properties.

Check the CC&R's as they will usually address these issues.

Here's one example. There is a vacant lot next to me. When my house was built the owner had the block fence constructed on the property line, and paid for the entire fence.

The CC&R's state that when the owner of the vacant lot builds, then he must pay the current owner of my property one half of the cost of building that fence.
