I'm not an expert but those look like termites to me. My new home came with a termite warranty, did yours? If so I'd call your builder and report this if they turn out to be termites.

I don't think they are termites, at least they don't look like those we had in Houston. But if they really bother you, I would call a Pest Control and have the yard sprayed for bugs. What you should do anyway. We had the complete exterior sprayed before we moved in.

They look like termites to me but I'm not a termite expert. Was there a heavy rain that soaked the ground lately? I think that sometimes sends them into swarm mode. Last year, after a big storm in the vicinity, a swarm went by (some of them have wings) and left my pool full of wings. But they didn't stop to munch on my house. Might want to wait a bit and see if they move off. Look every day around the foundation of your home and see if they make any tubes - that way the warranty people will know where to treat. Or - you can contact your warranty people and ask what they think you should do, since you're going to call them anyway.

Do they look like any of these, if not they are not termites.

The pictures are not clear to me but they look like they may be meal worms.
