Hi.

I'm trying to find out what our rights are in my condominium HOA. We are having issues where dues are being collected but normal maintenance to the property is not being done, nor are much-needed repairs (such a a new roof as our current one is almost 40 years old). This is resulting in the property falling into quite obvious disrepair. We are also dealing with a health issue where a pipe burst in a vacant unit and was not addressed for some weeks, meaning mushrooms and mold grew in the unit and part of the ceiling fell-in due to the humidity. The unit is a rental and the landlord is allowing it to default and has no intention of actually cleaning it up. Our HOA is not attempting to address this issue and we are concerned as we share a communal A/C unit with this unit.

We no longer know what is going on with our HOA as open meetings are not conducted. We are only able to sit-in on the "closed" meetings the board has with the management company to discuss budgeting and other "dry" issues. These meetings only occur as often as the state minimum requires (four times a year, I believe). Our HOA does not publish a newsletter or have a website to keep homeowners informed of what actions, if any, are being taken to address the various problems around the community.

If anyone can provide a link to useful information that could help us with a seemingly non-responsive HOA it would be greatly appreciated. Thank you.

Go to chapter 9 where deals with condos and start your research there.
