PITTSBURGH (KDKA) – A partial verdict has been reached on the fifth day of deliberations in the civil trial for three Pittsburgh Police officers accused of beating a former CAPA student.

The jury found that there is no evidence Jordan Miles was victim of malicious prosecution. That was the only count they could agree on.

According to KDKA-TV’s Harold Hayes, the jury was hopelessly deadlocked on the issues of false arrest and excessive force. On those counts, the judge declared a mistrial.

Miles’ attorneys said they will pursue a retrial on the the other counts that resulted in a mistrial.

The decision came a day after the jury told the judge they were having trouble reaching a unanimous verdict. However, the judge told them to go back and deliberate some more.

Miles had no comment on the deliberations that started at 3 p.m. Thursday. On Monday, there was a question from jurors which the judge decided to handle with a phone conference with attorneys without reconvening a court session.

This isn't a big surprise. Pittsburgh residents in general back the police and trust them. I wish Jordan wouldn't have ran and resisted. This wouldn't have been a story then. He might even have gotten a ride home.

Ah well, none of us where there and it is hard to say exactly what happened. The media is looking for a hype factor as they always do and that can't be trusted as accurate. One big sad mess.

He was clearly a victim of WWB aka Walking While Black... Judge was right... Jury's wrong IMO...

i'm not clear on what malicious prosecution means in this context (since charges against Miles were dropped pretty much immediately) but it's important to remember that that is the ONLY charge they were cleared of. this is not over.

He wasn't walking. He was running from the police and told to stop. If you are under the illusion that police just tackle people for no reason, I think you have some issues.

i guess your belief in "innocent until proven guilty" only applies to people you like. has jordan miles been convicted of resisting arrest?

in any case he was not running when they decided to pull over their car and accost him. no one disputes that.

kid, how does this make any sense??? the detectives were assigned to Homewood - where everyone is black! your comment tells me this was a racially motivated act of violence, when it CANT be. what about every other night they patrolled that area? did they beat up a black kid every single night?

i had a friend in DC who claims he was 'walking while hispanic". what bull - chances are, the police stopped to converse with him because they had a tip for robberies or something, w/ the suspect being hispanic - not a longshot at all in that city.
