Does anyone know if I'll be able collect unemployment.Due to not being able work my employer's schedule change. I'm scheduled off Saturday and Sunday right now. Starting January 5th 2018 my employer is scheduling me off Wednesday and Thursday. I have a court order stating I receive my child on weekends. When new schedule goes into affect. I will have to call off on Saturday and Sunday. Which will mean I will eventually be fired due to attendence policy. Up till now I have had a perfect attendance. 7 years. Will I be able to collect unemployment.

When you were hired 7 years ago were you verbally or in writing promised a certain schedule? If you could have worked Saturday and Sunday up until this court order but now cannot you may be out of luck. This is a tricky situation. If at all possible try to work it out with your employer. If you voluntarily quit you probably won't win your case.

From my experience, unemployment is very lenient with these sort of things and you most likely will quality but the employer will fight it. Don't quit and don't simply be a no call, no show. You need to have this conversation with your boss multiple times before January. Send them an email where you write "As we've discussed previously..." and keep that email along with their response for your records. You want a paper trail showing that your employer knew you could not work those days, but gave you no alternative. Sure, you can't sue your employer and win for firing you over this. But you can win a fight for unemployment insurance, which isn't that difficult to do. You can even collect unemployment if your car breaks down and you can't get to work anymore. The key is that you didn't quit and were fired to due no fault of your own. Also, make sure unemployment knows that you're ready and willing to work immediately and have applied at other places that meet your schedule requirements.

Expect your employer to fight this, so be really thorough when you explain this and write out what happened while filing for UC online. Remember to mention that you've never had any call-offs, no write-ups, spoke with your employer about this multiple times months in advance, and are currently willing and ready to work again immediately. Typically you only get about half your monthly salary in UC and it is taxable, so remember that. It's not a good way to live unless you're desperate. Start looking for other jobs NOW.
