On what basis was the moritorium overturned? Has this descision been appealed?

From what I heard, (so take it as, someone who heard posting), it had something to do with the fact that its not any unsafer to leave the oil sitting, than drilling, since the wells are already capped, oil already on the boats etc...

Obama plans to appeal, but the courts have a vacation planned so it'll sit for awhile..
