Scalia is an ultra-Catholic. The Catholic church is vehemently against any recognition of same sex partnerships (where sexual intimacy is involved), much less legal recognition from the State for those relationships. If the rabid anti-gay crowd insists that Judge Walker (an openly gay man) should have recused himself, then why wouldn't we ask strongly religious Justices like Scalia and Thomas to recuse themselves?
Not ALL heteros are so strongly and viciously against gays in the way that scalia is. At the ruling of Lawrence v Texas, he was literally foaming at the mouth in his blustering dissent, kind of the way that adolf hitler would talk about the jews. If the other conservative justices are anti-gay, they're not out shouting it from the rooftops in the manner that scalia does.
When the 9th District affirms on appeal, I predict SCOTUS will simply decline to grant certiorari at all. They prefer to leave questions like this up to the states.

I don't think they would overturn it. It'll probably be a 5-4 vote, but I think it would stand.
People don't get their cake and eat it too. If you were okay with a gay judge ruling(as I was) then you are okay with conservatives ruling...Only if you really want to appear fair and really want equality for all..Right?
bush vs gore was a situation where the florida supreme court was writing new election law from the bench rather than upholding florida election law and they needed to be slapped down.
as for any judge recusing themselves from any case, it should only be done if there is a true conflict of interest, such as the judge having a personal stake in the case.
In bush v Gore, both Scalia & Thomas had immediate blood relatives who stood to benefit from a Bush win. Thomas' wife Ginny worked for the Heritage Society and was in charge of reviewing resumes for Bush administration appointees. Scalia's son was an attorney for W and also in line to work for the bush Administration. wouldn't this meet the definition of "personal stake"? They should have recused themselves, imo. Likewise, I think that Scalia should recuse himself from this case should it reach the SCOTUS. His fiery diatribe against gay ppl after the Lawrence v Texas indicates a strong animus towards gay Americans.

Wow, I wasn't aware of Scalia's adamant anti-gay stance. But historically, some Supreme court justices were strong-headed and against certain social changes [discrimination against blacks] and were eventually out-voted by the other justices. That's the beauty of having 9 justices hearing cases.

Well, Walker was never grand marshal of a gay pride parade, nor activist for any Party or movement. Scalia OTOH has made hate speeches (imo anyway) about gay people and has spoken at catholic meetings. He has a outwardly strong dislike of gay people. I don't see how he could make an unbiased decision.
